At Desverso LLC (“Desverso,” “we,” “us”), we deliver custom digital services including Website Design & Development, Ecommerce, Mobile Application Development, Custom Software, UI/UX Design, Branding, Logo Design, Animation, SEO, Paid Advertising, Digital Marketing, Content Creation, and Consulting. Because our work is bespoke and labor-intensive from the moment a project begins, this Refund & Cancellation Policy is structured to protect both our clients and the operational integrity of our agency.
By placing an order, paying a deposit or invoice, or otherwise engaging Desverso LLC, you acknowledge that you have read, understood, and agreed to the terms set out below. This policy is incorporated into and forms part of our Terms of Use.
1. Eligibility for Refunds
Refunds are available only under limited circumstances and are not automatically guaranteed. A client may qualify for a refund only if all of the following conditions are met:
- No final design, development, or deliverable has been presented or approved.
- No revision has been requested or implemented.
- The refund request is submitted in writing within 5 business days of project payment or initiation.
- The project has not entered a strategy, research, wireframing, or planning phase.
- The client has not breached our Terms of Use, NDA, payment terms, or communication protocols.
Refunds do not apply once any work has been initiated, presented, revised, or communicated to the client.
2. Circumstances That Nullify Refund Eligibility
You are not eligible for a refund if any of the following apply:
- Any deliverable has been presented, reviewed, approved, or revised (e.g., logo drafts, page designs, app screens, mockups, wireframes, or code).
- You purchased a custom, discounted, or promotional package.
- Project milestones or phases have commenced or been completed.
- You requested custom features, integrations, or third-party API work.
- You failed to provide necessary project materials or content within 14 calendar days, causing delays.
- The creative brief lacked sufficient input for proper execution.
- The project scope changed after initiation (including full redesigns or a new direction).
- You requested to pause, cancel, or delay the project without a valid service-related cause.
- The cancellation is for non-service reasons such as a change of business direction or closure, internal disagreements, a change of mind, or finding a cheaper provider.
- You hired or collaborated with another provider or freelancer on the same project.
- You violated our Terms of Use, payment terms, NDA, or communication agreement.
- You failed to respond to project updates or team communications for more than 14 days.
- You engaged in abusive, unethical, threatening, or defamatory behavior toward our staff.
- You initiated a chargeback or payment dispute through your bank or payment processor.
3. Non-Refundable Services (Strictly Enforced)
The following are non-refundable under any circumstances once initiated:
- Domain registration, DNS setup, hosting (shared, VPS, or dedicated), or email configuration.
- Book publishing services (ISBN registration, layout formatting, print-on-demand, marketing setup).
- SEO campaigns (on-page/off-page work, keyword mapping, reporting).
- Social media and paid marketing campaigns (due to ad spend, content hours, and platform policies).
- Mobile app or software development beyond the UI/UX design phase.
- Any third-party tool, plugin, license, or service purchased on your behalf.
4. Cancellation Policy
You may request to cancel a project at any time by emailing info@desverso.com with your full name, invoice ID, and project name. Cancellations take effect only when acknowledged in writing by Desverso LLC. The following terms apply:
- Deposits are non-refundable. Initial deposits reserve our team's time and cover onboarding, scheduling, and planning, and are not returned upon cancellation.
- Work completed to date is payable. If you cancel after work has begun, you remain responsible for payment for all work performed and milestones reached up to the cancellation date.
- Pre-kickoff administrative fee. If a project is canceled before kickoff for reasons unrelated to our service delivery, a 33% administrative fee is deducted from any eligible refund to cover time, resource allocation, onboarding, and scheduling.
- Recurring services. Monthly or retainer-based services (e.g., marketing, SEO, maintenance) may be canceled with at least 14 days' written notice before the next billing cycle; the current cycle is non-refundable and services continue until the end of the paid period.
- Desverso LLC reserves the right to cancel or suspend a project for non-payment, breach of these terms, or abusive conduct, in which case no refund is due for work already performed.
5. Bundle or Package Purchases
For multi-service packages, a refund may be considered only for the specific component that has not been used, provided the client qualifies under all other conditions in this policy. No refund is issued for completed components or for the full package unless the entire bundle was left untouched, with no major revisions or approvals, the project at an early stage, and the client cooperative and transparent in communication. All partial refunds must be approved in writing by Desverso LLC management.
6. Refund Processing Time
- Approved refunds may take 7 to 14 business days to process and appear in your account.
- Refunds are returned only to the original payment method.
7. Intellectual Property in the Event of a Refund
- All materials, concepts, drafts, designs, and code shared during the project remain the intellectual property of Desverso LLC.
- Where a refund is issued, the client may not use, share, modify, or distribute any deliverable received.
- Unauthorized use may result in legal action, including copyright claims, DMCA takedowns, or lawsuits.
8. Chargebacks & Dispute Resolution
- Clients agree to contact us in good faith and allow us a reasonable opportunity to resolve any concern before initiating a payment dispute or chargeback.
- Initiating a chargeback in violation of this policy is considered a breach of agreement and may result in suspension of services and recovery of associated costs and fees.
- Any refund-related decision by Desverso LLC management is final and binding.
9. Agencies, Resellers & Subcontracted Work
Desverso does not offer refunds to creative agencies outsourcing work to us for their clients, freelancers reselling our services under white-label, or resellers or third-party brokers.
10. Governing Law
This policy is governed by the laws of the State of Washington, USA. Any disputes are subject to the exclusive jurisdiction of the courts located in Washington State, without regard to conflict-of-law principles.
11. Changes to This Policy
Desverso LLC reserves the right to modify, update, or amend this Refund & Cancellation Policy at any time without prior notice. The version in effect at the time of your agreement governs your refund rights.
