Desverso LLC – Refund Policy

At Desverso LLC, we are committed to delivering exceptional digital services including but not limited to Website Design & Development, Mobile Application Development, Custom Software, UI/UX Design, Branding, Logo Design, Book Publishing, SEO, Paid Advertising, Digital Marketing, Content Creation, and Consulting. While client satisfaction is our priority, our refund policy is structured to protect both the interests of our clients and the operational integrity of our agency.

Please review this policy carefully. By engaging with Desverso LLC, you accept the terms outlined below.

Eligibility for Refunds

Refunds are only available under limited circumstances and are not automatically guaranteed. A client may only qualify for a refund if all the following conditions are met:

  • No final design, development, or deliverable has been approved.
  • No revision has been requested or implemented.
  • The request for a refund is submitted within 5 business days of project payment or initiation
  • The project has not entered into a strategy, research, wireframing, or planning phase.
  • The client has not breached the Terms of Service, NDA, or communication protocols.

Refunds do not apply once any work is initiated, presented, revised, or communicated with the client.

Circumstances That Nullify Refund Eligibility

You are not eligible for a refund if any of the following apply:

1. Any deliverable has been presented, reviewed, approved, or revised (e.g., logo drafts, page designs, app screens, mockups, wireframes, or code).

2. You have purchased a custom, discounted, or promotional package.

3. Project milestones (phases) have commenced or been completed.

4. You requested custom features, integrations, or third-party API work.

5. You failed to provide necessary project materials/content within 14 calendar days, causing project delays.

6. The creative brief lacked sufficient input for proper execution.

7. The project scope changed after initiation (including full design overhauls or new direction).

8. You requested to pause, cancel, or delay the project without valid service-related cause.

9. The reason for cancellation is due to non-service related issues such as:

  • Change of business direction or closure
  • Disagreement with partners or internal team
  • “Change of mind” or “found a cheaper service”

10. You hired or collaborated with another service provider or freelancer on the same project.

11. You violated Desverso’s Terms of Service, Payment Policy, NDA, or Communication Agreement.

12. You failed to respond to project updates or team communications for more than 14 days.

13. You engaged in abusive, unethical, threatening, or defamatory behavior towards our staff.

14. You attempted to charge back the payment via your bank or payment processor.

Non-Refundable Services (Strictly Enforced)

The following services are non-refundable under any circumstances once initiated:

  • Domain registration, DNS setup, hosting (shared, VPS, dedicated), or email configuration
  • Book Publishing Services (ISBN registration, layout formatting, print-on-demand, marketing setup)
  • SEO Campaigns (on-page/off-page work, keyword mapping, reporting)
  • Social Media and Paid Marketing Campaigns (due to ad spend, content hours, and platform policies)
  • Mobile App or Software Development beyond the UI/UX design phase
  • Any 3rd-party tool, plugin, license, or service purchased on your behalf

Bundle or Package Purchases

If a client subscribes to a multi-service package, a refund may only be considered for the specific component of the package that has not been used, provided the client qualifies for refund under all other policy conditions. Refunds will not be issued for completed components or the full package unless the entire bundle was left untouched.

  • No major revisions or approvals have been made
  • The project is in an early stage
  • The client has been cooperative and transparent in communication

All such partial refunds must be discussed and formally approved in writing by Desverso LLC Management.

Administrative Cancellation Fees

If a project is canceled before kickoff due to reasons unrelated to our service delivery, a 33% administrative fee will be deducted from the refund to cover time, resource allocation, client onboarding, and internal scheduling.

Refund Processing Time

  • Approved refunds may take 7 to 14 business days to process and appear in the client’s account.
  • Refunds will be returned only to the original payment method.

Intellectual Property and Usage Restrictions

In the event of any refund:

  • All materials, concepts, drafts, and designs shared during the project remain the intellectual property of Desverso LLC.
  • The client cannot use, share, modify, or distribute any deliverable received.
  • Any unauthorized use will result in legal action, including copyright claims, DMCA takedowns, or lawsuits.

Dispute Resolution & Legal Action

  • Clients agree to engage in good faith discussion with their Project Manager or Desverso Client Success Team before initiating any public complaint or financial dispute
  • Any attempt to harm the company’s reputation or disrupt ongoing services without following proper dispute resolution channels will result in termination of services without refund and possible legal counteraction.
  • Any refund-related decision by Desverso LLC Management is final and binding.

No Refund Guarantee on Services Rendered to Agencies or Subcontractors

Desverso does not offer refunds to:

  • Creative agencies outsourcing work to us for their clients
  • Freelancers reselling our services under white-label
  • Resellers or third-party brokers

Final Note

Desverso LLC reserves the right to modify, update, or amend this Refund Policy at any time without prior notice, and the version in effect at the time of your agreement will govern your refund rights.

INTELLECTUAL PROPERTY RIGHTS

All content found on this site—including but not limited to logos, icons, visuals, text, designs, layouts, interfaces, company or service names, brand assets, documentation, and proprietary software—are protected under applicable intellectual property laws and remain the exclusive property of Desverso LLC or our licensed partners.

No part of this site or our delivered work may be reused, reproduced, distributed, licensed, or repurposed without our express written permission.

LIMITATION OF LIABILITY

While Desverso LLC makes every effort to provide accurate, up-to-date, and complete information across all digital platforms and services:

  • All information provided is of a general nature and must not be interpreted as personal, professional, legal, or business advice.
  • Desverso shall not be liable for any losses, damages, business interruptions, reputational harm, or data loss resulting from the use of our website, services, or third-party tools.
  • While we strive for uptime, we cannot guarantee constant, error-free operation of our site or services.
  • Desverso is not responsible for the content, security, or reliability of any third-party websites linked to from our platforms.
  • We reserve the right to modify, update, or discontinue site content, features, and links at any time without prior notice.

APPLICABLE LAW & JURISDICTION

This website and all services provided by Desverso LLC are governed by the laws of the State of Washington, USA. By engaging with us, you agree that any disputes shall be subject to the exclusive jurisdiction of the courts located in Washington State, without regard to conflict of law principles.

REVISIONS POLICY

Before any website or mobile application is deployed live, all required features, content, and revisions must be clearly communicated and finalized. Once the project goes live:

  • No further design, content, or layout revisions will be included unless under a separate maintenance or retainer agreement.
  • A post-launch maintenance plan is highly recommended for clients who require ongoing updates or technical support.
  • For all website orders, any claim for a full refund becomes null and void once the website layout(s) have been approved by the client.
